Terms and Conditions

General Terms & Conditions Disclaimer

The Terms and Conditions outlined on this page are intended to provide a general overview of Tonco Contracting Inc.'s policies and procedures. Each project is unique, and the specific Terms and Conditions applicable to your project will be outlined in your individual contract based on the scope of work, project requirements, and agreed-upon services. In the event of any conflict, the project-specific contract shall take precedence.

Estimate Validity
This estimate is valid for 30 days from the date issued unless otherwise stated. Pricing is based on current material, labor, fuel, and supplier costs at the time of quoting and may be subject to adjustment after the validity period expires. Due to fluctuations in market pricing and availability, increases exceeding the standard 10% may apply where significant changes in material costs, fuel surcharges, supplier pricing, site conditions, or project scope occur prior to the commencement of work. Any pricing adjustments will be communicated and approved before additional work proceeds.

Images & Renderings

Images, renderings, visual concepts, and project illustrations contained in our estimates, proposals, website, social media, or marketing materials may be created, enhanced, or modified using professional design software and artificial intelligence (AI) tools.

 

These images are intended solely for conceptual and illustrative purposes and may not represent exact dimensions, colours, materials, finishes, landscaping, construction methods, or final project details.

Final completed work may vary based on site conditions, engineering requirements, building code requirements, client selections, material availability, and the approved scope of work.

Scope of Work

Estimate includes only the work specifically identified within the written scope of work.

Any work not expressly included—including unforeseen conditions, concealed deficiencies, owner-requested modifications, or additional services—shall be considered extra work and may result in additional charges through an approved Change Order.

Deposits & Payments

Projects Under $10,000 (including HST)

  • 50% deposit required to secure scheduling

  • Remaining balance due upon project completion

Projects $10,000 and Above (including HST)

  • 20% deposit upon acceptance

  • 35% progress payment upon project commencement

  • 35% progress payment at approximately the midpoint of the project

  • Remaining 10% due upon issuance of the final invoice

 

Unless otherwise specified in writing, no statutory holdbacks will apply.

 

All invoices are due upon receipt.

 

Deposits are non-refundable once scheduling has been confirmed, materials have been ordered, or work has commenced.

 

Payments must be made directly to Tonco Contracting Inc. Payments made to subcontractors, suppliers, employees, or any third party shall not be considered payment to Tonco Contracting Inc.

Interest may be charged on overdue accounts at 2% per month (24% per annum) or the maximum rate permitted by law.

Use of Subcontractors

To ensure the highest quality workmanship and efficient project completion, Tonco Contracting Inc. may engage licensed, qualified, and fully insured subcontractors to perform specialized portions of a project. We work exclusively with trusted professionals who meet our standards for quality, safety, and reliability.

 

All subcontracted work is coordinated, supervised, and quality-controlled by Tonco Contracting Inc., and we remain fully responsible for ensuring the work is completed in accordance with the contract, applicable building codes, and industry best practices.

Scheduling & Delays

Project schedules are approximate and may be affected by weather conditions, material availability, inspections, permit approvals, utility locates, labour availability, site conditions, or other circumstances beyond our reasonable control.

Tonco Contracting Inc. shall not be liable for delays arising from these circumstances.

 

Access to Site
The client is responsible for providing clear and safe access to the work area. Delays caused by restricted access, unprepared areas, or third parties may affect scheduling and pricing.

Underground & Concealed Conditions

Tonco Contracting Inc. is not responsible for unforeseen underground conditions, concealed structural deficiencies, buried debris, undocumented utilities, rock, groundwater, unsuitable soils, asbestos, mould, hazardous materials, or hidden damage discovered after work has commenced.

Any additional work required will be discussed with the Client and completed only upon approval through a Change Order.

Permits & Approvals

Unless otherwise stated in writing, permits, engineering, surveys, utility locates, zoning approvals, inspections, and other regulatory approvals are the responsibility of the Client.

Where Tonco Contracting Inc. agrees to obtain permits on behalf of the Client, associated costs shall be included separately within the estimate.

Material Variations
Natural products such as brick, stone, concrete, and wood may vary in color, texture, and appearance. Exact matches to existing materials cannot always be guaranteed.

Change Orders

Any additions, deletions, modifications, substitutions, or revisions to the original scope of work requested by the Client, or required due to unforeseen site conditions, must be documented through a written Change Order approved by both the Client and Tonco Contracting Inc. before the additional work begins.

Approved Change Orders may result in adjustments to the contract value, project schedule, material requirements, and anticipated completion date.

Pricing for Change Orders shall include applicable labour, materials, equipment, subcontractor costs, overhead, and administrative expenses.

Verbal requests, site discussions, text messages, or emails shall not constitute authorization to proceed unless confirmed through a formal written Change Order.

Utility Locates

Tonco Contracting Inc. will obtain public utility locates where required by law. The Client is responsible for identifying and marking all privately owned underground utilities and structures, including irrigation systems, landscape lighting, invisible pet fencing, private electrical lines, propane lines, septic systems, wells, and drainage systems.

Tonco Contracting Inc. is not responsible for damage to underground services that are unmarked, inaccurately located, or unknown prior to the commencement of work. Any resulting delays or additional work may be subject to additional charges.

 

Warranty

Tonco Contracting Inc. warrants its workmanship for the period specified within the project contract.

This warranty applies solely to workmanship performed by Tonco Contracting Inc.

The warranty does not cover:

  • Normal wear and tear

  • Structural movement or settlement

  • Freeze-thaw cycles

  • Efflorescence

  • Weather-related damage

  • Acts of God

  • Improper maintenance

  • Abuse or neglect

  • Damage caused by third parties

  • Pre-existing conditions

  • Manufacturer defects (covered by the manufacturer where applicable)

Cleanup

Standard construction cleanup is included upon completion of the project.

Additional cleaning services, removal of hazardous materials, excessive debris disposal, or specialized site restoration requested by the Client may be subject to additional charges.

Cancellation

Deposits become non-refundable once scheduling has been confirmed, materials have been ordered, permits have been obtained, or work has commenced.

If the Client cancels after work has begun, the Client shall be responsible for payment of all labour performed, materials ordered, equipment costs, subcontractor charges, administrative costs, and any applicable cancellation fees incurred to the date of cancellation.

Insurance

Tonco Contracting Inc. maintains Commercial General Liability Insurance with coverage of not less than $2,000,000 CAD.

 

All employees of Tonco Contracting Inc. are covered by the Workplace Safety and Insurance Board (WSIB) where applicable.

Proof of insurance and WSIB clearance certificates can be provided upon request.
